The application of the following Terms and Conditions apply whether the contract is made verbally or in writing. The Hirer warrants full authority of all passengers to enter into Hire Agreement on their behalf and acceptance of all Terms and Conditions.
Terms & Conditions
Quote
All Quotations are subject to availability at time of booking and confirmation and payment conditions. Quotations are valid for 30 days.
Vehicle Use
Vehicles are not available for incidental use at any point between collection and return trip, unless agreed in writing between the Company and the Hirer, prior to commencement of hire.
Driver Hours & Rest Periods
All driver hours and rest periods regulations must be adhered to, except in the case of serious emergency and the Company may alter any hire which does not comply with regulations.
Seating Capacity
Licensed seating capacity must be strictly adhered to by the Hirer.
Animals
No animals are permitted on any hire with the exception of Companion and Guide Dogs and subject to written agreement by the Company prior to commencement of hire.
Confirmation
Written confirmation of hire by the Company is the only basis of acceptance of hiring or alteration to Terms and Conditions.
Payment
Payment in full is required 7 days prior to commencement of hire.
Payment Methods
The following payment methods are accepted:
- Direct Credit
- Credit Cards: Visa/Master credit cards only
- Cheque : Made payment to Coach Charters Australia P/L
(Cheques must be cleared 3 days prior to hire commencement)
Cancellation by Hirer
A minimum notice period of 3 days is required for a full refund. Less than 3 days notice will attract the following penalties to cover costs unless otherwise agreed in writing by the Company:
- 2 days notice 50% of Hire Agreement
- 1 days notice 75% of Hire Agreement
- Same day notice no refund
Variations to Booking
Variation to bookings require 3 days notice in writing. The Company reserves the right to make additional charges to cover costs for any variation to booking not previously agreed to.
Vehicles will depart per agreement with Hirer and the Company will be not be liable for any loss or injury sustained by any passenger who fails to join the vehicle at the agreed time.
If the vehicle is detained, delayed or taken on a longer journey than agreed, the Company reserves the right to make additional charges to cover costs incurred.
Cancellation by the Company
In the event of an emergency, adverse weather conditions, strike, mechanical failure or any other event beyond the control of the Company, or the Hirer taking unilateral action to vary agreed Terms and Conditions, the Company may cancel the contract without further or other liability or notice by returning monies paid.
Vehicle Provided
The Company reserves the right to provide a larger vehicle than agreed at no additional charge unless additional seats are used, in which case, additional charges will be made pro-rate to Hire charge.
Breakdown/Delays
The Company provides journey information in good faith and does not guarantee journey completion in any specified time. The Company will not be liable for any loss or inconvenience caused by breakdown or delay of the vehicle.
Passenger Property
Regulatory restrictions regarding carrying capacity must be adhered to. The Hirer accepts that the driver and only the driver will determine if and to what extent passenger luggage and effects can be carried.
The Hirer agrees that the passenger luggage and effects remain the sole risk of the passenger and the Company’s liability for loss or damage of whatsoever nature will be limited to the sum of $50 per bag, case or package.
The Company does not accept liability for any loss or damage to property left on the vehicle. All lost property will be held at the Company’s Depot for a maximum period of 3 months.
Passenger Conduct
The Hirer will be responsible for the conduct of passengers and for any damage caused by the passengers during the hire.
Complaints
Must be made in writing to the Company’s Office within 14 days of Hire completion.
Notices
No posters or notices to be displayed on any vehicle without prior written consent by the Company.
Refreshments/Alcohol
Consumption of alcohol is strictly not permitted on any vehicle at any time. Food and drink may not be consumed on the vehicle without prior written consent by the Company.
